If you think you have suffered a loss as a result of the purchase of a defective product or service you may be entitled to compensation.
Such losses can arise as a result of being sold an inappropriate specialist item or through the failure of goods before what might be considered a reasonable period of time. The claim may be against the company that sold the item to you or against the actual manufacturer of the goods in question.
Generally, compensation available in such claims is limited to those losses that occur as a direct result of the failed product or service. Any losses that are unforeseeable or do not arise as a direct result of the failure will not be recoverable e.g. the cost of having to hire a similar vehicle following the failure of a new
component would probably be recoverable whereas the time taken from work in order to take your vehicle to and from the garage in order to have it repaired would probably not.
In larger claims it is often necessary to seek the opinion of an expert witness who would prepare a report in relation to the damage caused and would express a view on whether the alleged failure of the goods or service is so unreasonable as to warrant compensation.
