What Happens Next on a Purchase

Before exchange of contracts your solicitor will:-



  • Check the draft contract submitted by the seller's solicitor

  • Submit questions about the property to the seller's solicitor

  • Submit searches to the local authority and the local water board to check matters such as planning permission and services affecting the property

  • Go through the contract and the responses to the questions and searches with you

  • Prepare the transfer deed and send it to the seller's solicitor for approval

  • Ask the seller's solicitor questions about the seller's title to the property

  • Ask you to sign the approved transfer deed and then send it to the seller's solicitor

  • Check you have your written mortgage offer in place

  • Agree with you and the seller's solicitor a date for completion of the purchase

  • Ask you to sign the contract.

After exchange of contracts your solicitor will:-



  • On behalf of your lender carry out a search to check you are not bankrupt

  • Carry out a search at the Land Registry to check no entries have been made on the Register since the seller's solicitor obtained copies of the entries

  • Apply to your lender for your mortgage advance

  • Ask you for any further funds required to complete the purchase

  • Complete the purchase

After completion your solicitor will:-



  • Pay your stamp duty

  • Register your purchase at the Land Registry

  • Send the deeds to your Lender once registration is completed

  • Send you a copy of your title as registered with the Land Registry together with any relevant documents your lender does not wish to store
