To make a successful claim for compensation three things have to be proved:

That a duty of care was owed to you. In most cases - establishing this is unlikely to be a problem.

That the standard of care received fell below that expected of a reasonably competent healthcare professional in that specific area of medicine, and thus was a breach of that duty of care.

That a significant physical or mental injury has been suffered as a result of that breach of duty of care.
Proving breach of duty of care and causation against a healthcare professional is often complex. It is therefore important that specialist legal advice is available as early as possible.
