Compensation claimed for personal injuries is called damages. It is divided into 2 parts.
This is the compensation you receive for the actual injury. The compensation awarded takes account of the nature of the injury, the treatment needed, the time it takes to recover from the injury, the pain you suffered and any long term problems. It also takes account of any impact the injury has on your activities for instance your inability to play sport for a period of time due to the injury.
This part covers the economic losses both past and future which you have or will incur. The past losses include items such
as loss of pay while you were off work due to the injuries, travel expenses attending hospital for treatment and medication costs. Future losses can include expenses such as the cost of nursing care which will be required in the coming years or future loss of pay if you are unable to return to your employment due to the injury. |
