TERMS OF USE OF THE WEBSITE

All use of the website http://www.hrjlaw.co.uk (‘the Site’), including registration to receive emailed newsletters (‘the Service’), is on the terms and conditions below (‘the Terms’). Please read these terms carefully before you start to use the Site. 

BY USING THE SITE AND/OR REGISTERING TO RECEIVE THE SERVICE YOU INDICATE THAT YOU ACCEPT THE TERMS AND THAT YOU AGREE TO COMPLY WITH THEM. IF YOU DO NOT AGREE WITH THE TERMS, PLEASE DO NOT USE THE SITE OR REGISTER TO RECEIVE THE SERVICE.

In the Terms ‘Content’ means data, text, software, music, sound, photographs, graphics, video, messages or other materials 

1. INFORMATION ABOUT US

The Site is operated by HRJ Law LLP (‘We/Us’). We are registered in England and Wales under number OC338662). Our registered office and main trading address is at 7/8 Portmill Lane, Hitchin, Hertfordshire, SG5 1AS.

Our VAT  registration number is 196459706.

Our service is provided by solicitors of England and Wales, regulated by the Solicitors Regulation Authority. You can access the Authority’s rules here: www.sra.org.uk

We maintain professional indemnity insurance in accordance with the rules of the Solicitors Regulation Authority. Details of the insurers and the territorial coverage of the policy are available for inspection at our offices.

2.   ACCESSING OUR SITE

2.1 Access to the Site is permitted on a temporary basis and we reserve the right to suspend withdraw or amend the Site or the Service without notice.  We cannot and do not guarantee that the Service and functions contained in the Site content will operate continuously or without interruptions, be error free, that defects will be corrected or that the Service, the Site or the server that makes it available are free of viruses or other harmful components.  We can accept no liability for our failure or inability to provide continuous, error-free, uninterrupted access to the Site and the Service under these or other circumstances [although we will use reasonable endeavours to rectify faults or problems to restore the Site to full operational capacity as soon as reasonably practicable where the Site is inoperative in full or in part for reasons within our control].

2.2 From time to time, we may restrict access to some parts of the Site to users who have registered with us.  

2.3 You are responsible for ensuring that your computer system meets all relevant technical specifications necessary to use the Site (and the Service if you register for it) and is compatible with the Site and for implementing sufficient procedures and virus checks (including anti-virus and other security checks) to satisfy your particular requirements for the accuracy of data input and output.

2.4 We have used reasonable endeavours to ensure that all Content complies with UK laws but we make no representation that it is appropriate or available for use in locations outside the UK. Those who visit the Site from other locations do so on their own initiative and are responsible for compliance with all applicable laws. If use of our Site and/or viewing of it, or use of any material or Content on our Site or services made available through it is contrary to or infringes any applicable law in your jurisdiction, you are not authorised to view or use our Site.  You must exit immediately.

2.5 We make no warranties, express or implied, that making the Content available in any particular jurisdiction outside the UK is permitted under any applicable non-UK laws or regulations. Accordingly, if making the Content or any part of it available in your jurisdiction or to you (by reason of nationality, residence or otherwise) is prohibited, the relevant Content is not offered for use by you. You accept that if you are resident outside the UK, you must satisfy yourself that you are lawfully able to use the Site and any services for which you register. We accept no liability, to the extent permitted by applicable law, for any costs, losses or damages resulting from or related to the access or attempted access of the Site and/or any services and/or any Content by persons in jurisdictions outside the UK or who are nominees for trustees for citizens, residents or nationals of other countries.

3. COPYRIGHT AND OTHER INTELLECTUAL PROPERTY RIGHTS

3.1 We are the owner or the licensee of all intellectual property rights in the Site, and in the Content published on it and in any materials provided to you through the Service throughout the world.  All such rights are reserved. 

3.2 You may display any pages of the Site and any materials you receive from us by email (which you are entitled to access in accordance with the Terms) on a computer and print off and download extracts of any page(s) from the Site provided that you maintain all copyright and other notices contained in them. You acknowledge that you do not acquire any ownership rights by downloading copyright materials.

3.3 You may not modify, [publish, transmit, transfer or sell, lease,] create derivative works from, [distribute, display,] or in any way exploit any of the Content or any materials we send you by email, in whole or in part, except as is expressly permitted in the Terms.

3.4 You agree that, except as expressly permitted by law, you will not modify, reverse engineer, disassemble, decompile, copy, adapt or translate any part of the Site, any software used on the Site or any Content and that you will not permit any other person to do so.  

3.5 The trademarks and logos used and displayed on the Site including the logo [insert logo] are unregistered trademarks of HRJ Law LLP and may not be used unless permitted by these Terms or, otherwise, without our prior consent. 

4. RELIANCE ON INFORMATION POSTED

4.1 Although we hope that the Site will be of interest to users, Content published on the Site and materials provided to you through the Service are provided for general information purposes only and are not intended to be a substitute for individual professional legal advice where you have a specific legal query.  Do not disregard current specific legal advice as a result of general information you have read on this site. 

4.2 We try to ensure that the Content is current, correct and clearly expressed but it may contain typographical errors or other inaccuracies. Please note that laws and regulations often change and any of the material on the Site may be out of date at any given time. 

4.3 Any statements of the law on the Site or contained in newsletters refer to English law only. If you are subject to the laws of another jurisdiction we would advise that you find a local source of information.

5. OUR SITE CHANGES REGULARLY

We aim to update the Site regularly (although we are not obliged to do so), and may change the Content at any time without giving you prior notice of our intention to do so.    

6. OUR LIABILITY

6.1 We display materials on the Site and provide them through the Service free of access charge. As such, they are provided without any guarantees, conditions or warranties as to their accuracy or otherwise.  To the extent permitted by law, we expressly exclude:

a. All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.

b. Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with the Site or in connection with the use, inability to use, or results of the use of the Site (and any websites linked to it and any materials posted on it) and the Services including, without limitation any liability for loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; loss of data; loss of goodwill; wasted management or office time; and 

c. Any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

6.2 We accept liability where it cannot be excluded or limited under applicable law including liability for death or personal injury arising from our negligence and for fraudulent misrepresentation or misrepresentation as to a fundamental matter.  

7. INFORMATION ABOUT YOU AND YOUR VISITS TO OUR SITE

We process information about you in accordance with our privacy policy.  By using the Site, you consent to such processing. When you register to use the Service we require you to read and agree to the use of your personal information (including sensitive personal information) in accordance with our privacy policy.

8. CHARGEABLE SERVICES

All chargeable individual legal services we provide, whether they are funded by you personally or by a third party, are provided under a separate contract with you.  The Terms do not apply to any such professional services.

9. LINKING TO AND FROM THE SITE

9.1 The Site and newsletters sent to you through the Service may contain links to other websites that are created and maintained by third parties.  We have included these links because we think that visitors to the Site may find them of interest but we do not keep the linked sites under review.  We are not responsible for and do not necessarily endorse the practices or content of any off-site pages or goods or services offered on them or any other site linked to the Site, and the inclusion of links does not imply association by us with any third party.  Such linked sites are for your convenience only and you access them at your own risk.  We make no representations or warranties as to the accuracy or functioning of any such link.  We will not be liable under any circumstances for loss or damage arising out of your use of any site with which the Site is linked.

9.2 Although we are keen to increase usage of the Site, we do not authorise any linking with other sites without our prior emailed approval.  If you email us with full details of your proposed link site, we will notify you whether we agree to the creation of the relevant link.  Even if we give such consent, we may not keep the content of other websites linked to the Site under review and such consent does not necessarily constitute endorsement by us of the owner of the other site, the contents of its site or its products or services.

9.3 We are not responsible for the data protection policies of any site to which links are provided on the Site.  

9.4 When you purchase goods or services, having been directed through a link to a third party, any contract you choose to form with them, or use of their website is a matter between you and them.  We do not accept any liability for the quality or type of services or goods provided by those whom we mention on the Site or to whom we have linked the Site.  It is for you to make your own judgement about the quality of such providers.  We exclude all liability both under contract and under the law of tort, including (without limitation) liability for misrepresentation to the fullest extent permitted by law in this respect. This does not affect your statutory rights against the third party seller.

10. GENERAL

10.1 You agree to indemnify and hold us harmless from and against any claim or demand (including reasonable legal fees) made by a third party relating to or arising out of the breach of this agreement by you.

10.2 The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to the Site or use of the Service.  These terms of use are governed by English law. 

10.3 Any formal legal notices arising out of your use of the Site or the Service should be sent to us at 7/8 Portmill Lane, Hitchin, Hertfordshire SG5 1AS.  We do not accept service of notices by email.


10.4 We reserve the right to change the Terms and Privacy Policy at any time. If you continue to use the Site for ten days after the revised terms are posted on the Site, you will be deemed to have accepted them.

10.5 If any provision of the Terms or the Privacy Policy is held by any competent authority to be void, invalid or unenforceable, then it shall be deemed to be amended only insofar as it is necessary to make it enforceable whilst retaining its purpose or deleted if it is not possible to do so.  The validity of the other provisions of the agreement and remainder of the provision in question (if any) shall not be affected thereby.  

10.6 No waiver by us in exercising any right or remedy shall operate as a waiver of any other right or of that same right at a future time nor shall any delay in exercising any power or right or failure to insist upon strict performance of your obligations under our agreement be interpreted as a waiver.

10.7 In the event of a dispute arising out of or in connection with the Terms then you agree to attempt to settle the dispute by engaging in good faith with us in a process of mediation before commencing litigation.
